In addition to certification of the pipeline, the agency must also consider an application for recognition of Nord Stream 2 AG as an independent operator, which will circumvent the EU Gas Directive. According to lawyer Cornelia Zim, who is collaborating with the German Environmental Organization in a lawsuit to revoke a permit to build a gas pipeline, the Network Agency should assess whether the long-term transformation of Ukraine's energy sector can ensure its security in the short term. The article notes that the Federal Network Agency may drag out the preparation of the draft decision for four months, after which it will have to be evaluated by the European Commission. According to some reports, the decision on certification of the gas pipeline may be made in May next year.
