MOSCOW, 18 Sep. Accepted inheritance can be onerous. In accordance with the Civil Code of the Russian Federation, the inheritance includes property rights and obligations, that is, debts. Honored lawyer of Russia Ivan Soloviev told the Prime agency about this. A citizen can declare his right to inheritance within six months. The inheritance is transferred in its entirety, along with the existing obligations. For example, you cannot inherit an apartment and refuse mortgage payments for it. Or take a car, refusing to pay a car loan, Soloviev draws attention. The lawyer advises to evaluate the inheritance taking into account debt obligations and make an informed decision. We'll have to pay the testator's debts for housing and communal services and mortgages, if any. This also includes outstanding loans. If the value of the debts exceeds the price of the property, the heir is obliged to pay off the difference, the expert notes. You can only give up an inheritance in its entirety, and a number of debts are not inherited. This, for example, is money borrowed from individuals and is not notarized in the proper form. This also includes payments for alimony, penalties and penalties under contracts (except for credit), as well as obligations to compensate for damage to the health and property of another person, the expert concluded.
