The Lyublinsky District Court of Moscow will consider the issue of abolishing the conditional sentence for Alexei Navalny's brother Oleg Navalny, who was convicted in a «sanitary case». The file of the case is published on the website of the court.
According to the information on the website of the court, the petition for the annulment of the decision was registered on January 24. As a reason for it, the convict's failure to fulfill the assigned duties, evasion of compensation for harm or the commission of a new crime (parts 2.1, 3, 4 of Article 74 of the Criminal Code, paragraph 7 of Article 397 of the Criminal Procedure Code) are indicated.
As Interfax writes with reference to the press service of the court, the submission came from the penitentiary inspectorate. RIA Novosti adds that the conditional term is required to be replaced with a real one.
Navalny’s lawyer Nikos Paraskevov noted in a conversation with Mediazona that the court did not notify him of the appointment of the meeting.
In August 2021, the Preobrazhensky District Court of Moscow appointed Oleg Navalny a year of probation, he was found guilty of inciting to violate sanitary standards (part 4 of article 33, part 1 of article 236 of the Criminal Code).
According to investigators, the defendants in the “sanitary case” urged people to go to the rally on January 23, which is why Muscovites who were supposed to be in quarantine came to the city center — this created a threat of “mass disease of people” .
