In the event of an accident, drivers must be checked for alcohol or drug intoxication without fail
In Ukraine, they may introduce a mandatory test for intoxication for participants in road accidents (RTA). The corresponding bill No. 6558 has already been registered in the Rada, reports the Chronicle.info with reference to RBC-Ukraine.
What is proposed
People's deputies propose to supplement Part 1 of Art. 226 of the Code of Administrative Offenses of Ukraine with a clause that in the event of an accident drivers must be checked without fail for the state of alcohol or drug intoxication, or being under the influence of drugs. And here we are talking about an accident with victims.
It is also proposed to supplement clause 2, part 3, article 214 of the Criminal Code of Ukraine with a proposal that a mandatory medical examination of the driver is carried out when an accident occurs.
< p>In addition, amendments to the law «On emergency medical care» will allow such examinations to be carried out in emergency departments of multidisciplinary hospitals.
Why they decided to take on tightening control
The explanatory note to the bill states that road accidents remain one of the main threats to the life and health of Ukrainians. For 10 months of 2021, 2.3 thousand accidents with victims occurred in Ukraine, in which 2,592 people died.
At the same time, violations of traffic rules or the operation of transport by persons in a state of alcoholic or drug intoxication are of particular danger.
How is the examination of participants in an accident
Note that today the examination of participants in an accident for alcohol or drug intoxication is carried out at the discretion of the police.

In particular, the police, if there are signs of intoxication, may offer to undergo an inspection at the place where the car stopped in the presence of two witnesses. The results of such an inspection are indicated in the examination certificate using special breathalyzers.
This act must be drawn up in two copies, one of which is given to the driver against receipt. If the fact of driving in such a state is established, then a protocol on an administrative violation is drawn up.
The basis for punishment is the recognition of the driver himself and the absence of objections from his side based on the results of the inspection.
If the driver objects
If the driver does not want to undergo an examination on the spot, then he is sent to the hospital no later than 20 hours from the moment of stopping. An examination for drugs or alcohol is carried out using devices approved by the Ministry of Health. After that, the doctor draws up a conclusion in triplicate.
If the driver refuses to conduct an examination in a medical facility, the police officer, in the presence of two witnesses, draws up a protocol on an administrative offense, in which he indicates clinical signs of intoxication and the driver's refusal to examine.
