They were captured and accused of mercenarism (Article 430 of the Criminal Code of the DPR ), although all three officially joined the Armed Forces of Ukraine even before the start of the war. In addition, they were charged with “training for the purpose of carrying out terrorist activities” (Article 232 of the Criminal Code of the DPR) and “forcible seizure of power” (Article 323 of the Criminal Code of the DPR).
Eslin, also known as Cossack Gundi, is married to a Ukrainian woman, in 2018 he took the oath and began to serve in the 36th Marine Brigade of the Armed Forces of Ukraine. The fact that he was captured by the Russian military became known on April 12.

Together with Eslin, his friend, 48-year-old former military officer of the Royal English Regiment, Sean Pinner, was captured. Sky News and the Guardian wrote that he joined the UAF in 2018 and served in the 36th Marine Brigade. Pinner is also married to a Ukrainian.
21-year-old Moroccan citizen Brahim Saadoun surrendered on March 12 in Volnovakha, his lawyer Dmitry Ershov said.
According to the defender, Saadoun could not find a job and go to university in his native country, so he moved to Ukraine. The family bought him a $100 ticket to Poltava. In 2021, he signed a three-year contract with the Armed Forces of Ukraine and, as Yershov noted, on the recommendation of Briton Eslin, he ended up in the 36th Marine Brigade.
According to the Russian Ministry of Defense, 6,824 people from 63 countries: 1,717 from Poland, about 1,500 from the USA, Canada and Romania, 300 each from the UK and Georgia.
“Foreign mercenaries do not have the status of combatants under international humanitarian law. They came to Ukraine to earn money by killing Slavs, so the best thing that awaits them is criminal liability and long prison terms,” said agency spokesman Igor Konashenkov.
