The Gatchina City Court of the Leningrad Region declared the mobilization of a local resident Pavel Mushumansky illegal. This was announced by the head of «Agora» Pavel Chikov.
Mushumansky's lawyer Alexander Peredruk told Mediazone that in 2021 the young man completed alternative civilian service (ACS) instead of fixed-term service. Then he intended to pass the ACS on religious grounds — the draft board satisfied the application of the Gatchina resident.
However, in September of this year, after the announcement of «partial mobilization», Mushumansky was given a summons, summoned to the military enlistment office and it was decided to send him to military unit No. 29760 in the Pskov region, Peredruk explained.
Mushumansky turned to the command with a report on exemption from military service on religious grounds, and then filed a lawsuit in court, which on October 12 suspended the decision on his mobilization until the case was considered on the merits. As a result, the command returned the young man from the unit to participate in the process, and today Judge Marina Girenko satisfied the suit of the Gatchina citizen.
In late October, the State Duma adopted amendments on alternative service during mobilization. An article appeared in the relevant law, according to which the ACS in the organizations subordinate to the Armed Forces must remain in place.
Before the adoption of the bill, military registration and enlistment offices refused to accept applications for transfer to alternative civilian service from those who received mobilization summonses, the courts still continue to deny citizens this right.
