Russian Railways does not agree with a number of conclusions of the Prosecutor General's Office and the Federal Treasury about violations in the implementation of projects for the development of the BAM and the Trans-Siberian Railway, said Oleg Belozerov, general director of the monopoly. He wrote a letter outlining the position of the company.
The first stage of the BAM-Transsib development project has not been fully implemented, the second stage is lagging behind, many violations are revealed, Ekaterina Peresypina, a representative of the Prosecutor General's Office of the Russian Federation, said on Monday.
«I am in contact with the Prosecutor General's Office, with the leadership of the Prosecutor General's Office. We analyze in great detail almost all the elements that occur in derogations and violations. The Prosecutor's Office is a body that oversees the legislation. And they clearly have black or white, but the question is black or white is a matter of interpretation. But, as far as I understand, yesterday there was a reference, including to an audit of the Federal Treasury, there should have been. I can say that we are actively discussing and absolutely disagree with a number of positions,» Belozerov said on Tuesday speaking in the Federation Council.
According to him, Russian Railways is an economic entity. “Accordingly, we decide what to do, effectively or inefficiently. Yes, colleagues write that from their point of view it would be advisable to do this and that. I signed a counter letter to the Federal Treasury, there are about 700 sheets, outlining of our position with reference to the legislation in the same way. I'm not saying that we are 100% right or wrong,» Belozerov continued. He gave an example in this regard. «An uncommissioned object is considered if grass has not been sown and a noise barrier has not been installed. Russian Railways added that under the projects of the first stage of the development of the BAM and the Trans-Siberian Railway, the movement of trains was organized, which made it possible to achieve a total carrying capacity of the railways of the eastern landfill in the amount of 144 million tons, and the transit transportation of containers doubled in 2018-2020. Also, the achievement of the upper limit of the indicator of the passport of the project for the export of coal and ore from the main deposits of the Eastern landfill at the level of 124.9 million tons (+66.8 million tons in addition to the level of 2012).

Speaking about the possibility of temporary operation of railway infrastructure facilities, Russian Railways reported that it is provided for by federal law and a number of other regulatory documents. Temporary operation is subject to objects with a high degree of construction readiness, for which at the time of registration of commissioning for temporary operation, about 25-30% of the total amount of work that does not affect traffic safety remains unfinished.
«The performance of these works is often seasonal, which makes it impossible to fully complete the work during the cold season. The readiness of the facility is determined by the relevant commission. On the issue of testing bridges, they clarified that, in accordance with the current SNiP, bridges with spans over 100 meters and pedestrian bridges are subject to testing. «As part of the facilities put into temporary operation in 2022, only 2 artificial structures are subject to testing — the Lensky Bridge and the pedestrian bridge at the Onokhoi station. These activities were successfully carried out by IGUPS, which has the necessary license. Based on the results of the work, the acceptance committee confirmed the technical readiness of the structures and the railway track for temporary operation. The operating divisions carry out constant monitoring of the state of railway tracks and structures that are in temporary operation. Russian Railways was assured that they constantly monitor the fulfillment of contractual obligations by contractors.
«If violations of the terms of the contract are revealed, a claim is sent to the contractor without fail. In case of failure to satisfy the stated claim requirements, the recovery is carried out in court in accordance with the legislation of the Russian Federation,» the monopoly noted.
Decisions on advance payment are made on the basis of information about the schedule performance of work, the availability of production facilities necessary for the development of work on the project, as well as an analysis of the financial condition of the contractor, which is confirmed by the dynamics of the decrease in receivables by periods, the company explained.
