The Kirovsky District Court of Perm acquitted police officer Oleg Burnyshev, who had beaten to death a local resident, Yuli Luzyanin, who had reported the theft. 59.RU reports this with reference to the security official's lawyer.
Burnyshev was accused under the article on causing grievous bodily harm resulting in death by negligence (part 4 of article 111 of the Criminal Code). On March 24, he was also acquitted by a jury.
According to investigators, in February 2022, a policeman came to a house call to Yuliy Luzyanin, who reported the theft of a tablet and a TV. According to Burnyshev, during the conversation, the owner of the apartment told the security official that he was watching child porn on the tablet. After that, the policeman decided to interrogate Luzyanin's paralyzed mother, but the owner of the apartment was against it and shouted: «Don't you dare!»
Then, according to the security official, the man grabbed him by the jacket, and when the policeman pushed him away, he picked up a knife and attacked. Because of this, the defendant said, he was forced to resort to self-defense: Burnyshev struck Luzyanin several times with his fist on the body. After that, the owner of the apartment sat on the sofa without saying anything, and the security officer went to interrogate his mother. Returning from the woman's room, he saw that Luzyanin was lying on the floor, blood was flowing from his mouth. Despite the medical assistance provided, the man died.
The mother of the deceased said that when the security officer entered her room, he was without a shirt. “Suddenly it comes up again. He knelt down in front of me, wept and said, «He's dead.» I say, «Who died?» He: «Your son.» How did he die? I tell him: «Did you kill him?» He says: «Let's go and see.» But I don't go. He grabbed me and dragged me. I fought him off with a stick. He says: “Look that he is dead,” the woman added.
As follows from the data of the forensic examination, the deceased had a combined injury to the head, chest and abdomen, a fracture of the sternum, ruptures of the lung and liver. The man suffered a traumatic shock, cerebral edema, and hemorrhage in the lungs.
After that, a criminal case was opened against Burnyshev, and he was fired from the Ministry of Internal Affairs «in connection with the commission of an offense discrediting the honor of an internal affairs officer.» During the investigation and consideration of the case by the court, he was in a pre-trial detention center. “The prosecutor's office has 15 days to appeal the verdict. If the verdict comes into force, we will definitely apply for rehabilitation,” Burnyshev’s lawyer told 59.RU.
