As reported, the relevant initiative was approved by the government commission on draft legislation. It provides for several key points: firstly, the threshold is raised to a million rubles when a citizen can go through a simplified procedure — that is, without a trial — the personal bankruptcy procedure. In addition, pensioners will now also have the opportunity to use the simplified bankruptcy mechanism. At the same time, it is noted that this will affect only those pensioners who live only on pensions or social benefits.
As noted, before the initiative, pensioners could not use the simplified bankruptcy procedure, so the recovery within the framework of enforcement proceedings actually became indefinite. According to the initiative, a year after receiving a writ of execution from bailiffs, a pensioner can apply for debt relief out of court. It will be possible to apply to the MFC.
In addition, the fulfillment of the condition that the only income of a citizen is a social payment is declarative in nature and does not require additional documentary evidence. In addition, it is proposed to reduce to 25 thousand rubles the minimum amount of debt for which it will be possible to start bankruptcy proceedings.
