The Podolsky City Court of the Moscow Region declared Wildberries' conditions illegal, according to which customers are charged for the return of defective goods purchased on the marketplace. It is reported by RBC with reference to the deputy head of the regional department of Rospotrebndzor Nikolay Drozd.
The claim of the Moscow Region Department of Rospotrebndzor against Wildberry LLC was registered in early March, follows from the card on the court's website. On April 13, he was satisfied.
As Drozd clarified, if the buyer notices that the product he bought is not of adequate quality, then he has the right to demand a replacement with a recalculation of the price, free elimination of defects, full compensation for losses, and may also refuse to purchase and receive money spent on products.
The Wildberries system for refusing goods is designed in such a way that if it is not in demand, money is withdrawn from the buyer for return delivery — from 100 rubles. At the same time, the marketplace does not share purchases that were not picked up from the pickup point due to marriage and because of the desire of the consumer, writes RBC with reference to the consumer offer.
A representative of Wildberries in a conversation with the publication noted that the company intends to appeal the decision of the Podolsky court. “The court did not fully understand the circumstances of the case: representatives of the company were not present because they were not properly notified and were unable to present their arguments,” he added.
In addition, according to RBC's interlocutor, the return of defective goods «was and remains free for buyers», since the cost of the product and its return delivery to the warehouse is compensated by the seller himself. At the same time, the return of goods of good quality must be paid — otherwise, “the company’s free services are abused,” the marketplace representative noted. fines.
