MOSCOW, May 29 Russian President Vladimir Putin signed a law on the possibility of early recall of a senator by the authority of the subject that endowed the parliamentarian with such powers. The corresponding document is published on the official Internet portal of legal information.
«A senator of the Russian Federation — a representative of a constituent entity of the Russian Federation may be recalled before the expiration of the term of office by a decision of the Federation Council on the proposal of a state authority of a constituent entity of the Russian Federation that has made a decision to grant him the powers of a senator of the Russian Federation,» the law says.
A proposal for recall cannot be submitted within a year after the appointment of a senator or less than 3 months before the end of the parliamentarian's term of office. If the Federation Council rejects this submission, the body that made the submission may re-submit it no earlier than six months after the rejection.
At a meeting of the constitutional committee of the Federation Council, it was explained that the criteria for motivating an early recall of a parliamentarian were not specifically established, because if it is not a question of a person breaking the law, then it is a matter of political responsibility.
According to the federal law «On the procedure for forming the Federation Council of the Federal Assembly of the Russian Federation», if the position of the governor is elective, then the candidate for this position also submits three candidates to the election commission, one of which, if the governor is elected, will be vested with the powers of a senator of the Russian Federation — representative from the executive authority of the subject.
The committee also explained that the candidate for the senator, who will be proposed instead of the recalled one, will be from the same original trio.
