The Zaozersky garrison military court of the Murmansk region sentenced an officer to two years in a colony-settlement because of his refusal to go to war, the military lawyers project reported, citing a lawyer who was present at the meeting.
The state prosecution asked the officer for two years and 11 months in prison in a colony-settlement. According to the case file, serviceman Oleg A. has been serving under a contract in the Murmansk region since 2019 and was the commander of a motorized rifle platoon. According to the court, in December 2022, he twice refused to go to the war zone.
Judge Vladimir Boldyrev on July 4 found the contractor guilty of failure to comply with the order during the period of mobilization (part 2.1 of Article 332 of the Criminal Code). The defendant pleaded guilty and said that he refused to fight, since at that time there was a trial on his dismissal from the service.
According to the serviceman, in August 2022, the commander of the military unit issued an order to dismiss him, but did not exclude Oleg A. from the lists of personnel before the start of mobilization. Because of this, the officer could not quit and went to court, which sided with the command. The human rights project «Military Lawyers» explained that they tried to send a contract soldier to war when he tried to challenge the refusal to dismiss in the appellate instance.
