The State Duma in the second reading approved a bill that prohibits the change of a gender marker, as well as operations related to a transgender transition. The meeting is broadcast on the website of the lower house of parliament.
Amendments are being made to the Family Code, as well as to the federal laws «On acts of civil status», «On the basics of protecting the health of citizens» and «On citizenship».
Now, according to the Family Code The marriage ends due to the death of one of the spouses. Now, in the second reading, the deputies are introducing one more reason — «change of sex by one of the spouses.» In addition, people who have made a transgender transition are prohibited from adopting children and being guardians.
The law «On acts of civil status» now states that changes to documents can be made if a person has submitted a document on «sex change issued by a medical organization.» In the draft law adopted in the first reading, the deputies excluded this item altogether. By the second reading, it was decided not to remove it, but to reformulate it. According to the amendments, now documents can only be changed if a person provides a medical certificate “on the conformity of sexual characteristics to the characteristics of a certain sex.”
On the basis of the same document, the passport of a Russian citizen will be invalidated. The current legislation states that the passport expires 90 days after «sex change».
A separate new article appeared in the law «On the Fundamentals of Protecting the Health of Citizens». In the version of the draft law adopted in the first reading, it sounded like this: «Medical workers are prohibited from carrying out medical interventions aimed at changing the sex of a person, including the formation of primary and (or) secondary sexual characteristics of the other sex in a person.»
For the second reading, the deputies clarified the wording: “It is prohibited to carry out medical interventions, including the use of drugs aimed at changing the sex, including the formation of primary and (or) secondary sexual characteristics of the opposite sex in a person.”
“Sex reassignment,” the authors of the initiative clarify, will not include operations related to the treatment of “congenital anomalies (malformations), genetic and endocrine diseases associated with impaired formation of the genital organs in children.” Such operations will be carried out only by decision of medical commissions controlled by the authorities. After such an operation, it will be possible to change the gender marker.
When the bill is signed by Vladimir Putin, it will come into force from the day of its official publication. The amendments will not apply to those who underwent surgery before the entry into force of the law.
