The Krasnodar Regional Court, during an appeal, acquitted policemen Vyacheslav Zyabkin and Vladimir Tatarkov, who were accused of breaking the leg of detainee Yevgeny Marchenko. This is reported by the “Team against torture”.
At the same time, the first instance — the Prikubansky District Court — in mid-June 2022 decided that the police were guilty: Zyabkin was given four years of probation, and Tatarkov — three years of probation. The policemen were tried in the case of abuse of power with the use of violence and special means (points «a» and «b» of part 3 of Article 286 of the Criminal Code), the prosecution requested real terms.
According to the investigation, in March 2019, Marchenko tried to climb over the fence of his own house to pick up the keys. This was seen by Zyabkin and Tatarkov, who were patrolling the street. The victim recalled that the police ran up to him, threw him to the ground and started beating him, hitting him with a baton on his leg.
The security forces handcuffed the Krasnodar man and wanted to take him to the police station. After some time, Marchenko's mother, who came running to the screams, convinced the patrolmen to let him go. Doctors diagnosed the victim with a closed leg fracture, which was qualified by an expert as a serious bodily injury.
The case against the security forces was opened in April 2019. Then they were sent to jail.
Team Against Torture lawyer Sergey Romanov said that human rights activists intend to file a cassation appeal against the acquittal.
