In August, the Novosibirsk Garrison Military Court issued ten sentences to servicemen in cases of unauthorized abandonment of a military unit (Article 337 of the Criminal Code); one of the decisions entered into force, four more were appealed. Mediazona drew attention to this.
In what cases did the court pass sentences in August:
August 2 Private Nabidjon Sadykov was sentenced to five and a half years in a colony of the settlement (Part 3.1 of Article 337 of the Criminal Code and Part 5 of Article 337 of the Criminal Code). According to investigators, on December 27 last year, he «departed to the place of residence, where he began to live with his family, spending time at his own discretion.» The serviceman appeared at the military registration and enlistment office on January 15, and the very next day he left the military unit again. He was arrested on March 7th. The verdict did not enter into force, as it was appealed.
August 3Private Alexei Krivda was sentenced to five years and one month in a penal colony (Part 5 of Article 337 of the Criminal Code). He did not appear at the military unit on December 27, 2022 «in order to take a break from military service without good reason,» the investigation believes. On February 15 of this year, Krivda himself came to the military commandant's office and declared himself. The verdict did not enter into force, as it was appealed.
August 9 Private Andrei Ivanov was given five years in a general regime colony (Part 5 of Article 337 of the Criminal Code). He, according to the security forces, “without good reason” did not appear at the military unit after the end of his vacation on February 28 this year. The private turned to the military commandant's office on April 3. The verdict did not enter into force, as it was appealed.
August 10Private Vladimir Labzin was sentenced to five and a half years in a colony-settlement (Part 3.1 of Article 337 of the Criminal Code and Part 5 of Article 337 of the Criminal Code). According to the investigation, from December 29, 2022 to January 20, 2023, he was absent from work until he was detained by the military police at the City Clinical Hospital No. 34. Three months later, the private left the unit again and came to the military investigation department only at the end of May.
August 16Private Vasily Ananiev was sentenced to five years in a colony-settlement (Part 5 of Article 337 of the Criminal Code). “In order to temporarily evade military service, wanting to take a break from it,” on December 10, 2022, the serviceman left the military unit, the investigation believes. On February 21, 2023, having learned that he was wanted, the private came to the military registration and enlistment office. The verdict did not enter into force, as it was appealed.
August 18 junior sergeant Kirill Arslanov was given a five-year suspended sentence with a three-year probationary period (part 5 of Article 337 of the Criminal Code). According to the security forces, from January 30, 2023 to May 19, 2023, Arslanov spent time «at his own discretion», not being in the service in the Moscow region. As a result, he was detained by the Novosibirsk police.
Also on August 18, the verdict was handed down to Sergei Rostovtsev. He was found guilty of leaving the unit without permission for a period of more than one month during the period of mobilization (part 5 of article 337 of the Criminal Code) and of illegal acquisition, storage and manufacture of drugs (part 1 of article 228 of the Criminal Code). What kind of punishment he was given is unknown.
August 24the court ruled in the case of serviceman Vasily Belyakov on unauthorized abandonment of service lasting more than two days, but not more than ten days, during the period of mobilization (part 2.1 of article 337 of the Criminal Code). It is not known what kind of punishment he was given.
August 30 Daniil Drugov was sentenced in the case of unauthorized abandonment of the unit for a period of more than one month during the period of mobilization (part 5 of article 337 of the Criminal Code). The press service of the court has not yet published the details of the verdict.
August 31 Alexander Shipitsin was sentenced. He was found guilty of unauthorized abandonment of the service lasting more than two days, but not more than ten days, during the period of mobilization (part 2.1 of Article 337 of the Criminal Code) and of unauthorized abandonment of the unit for a period of more than one month during the period of mobilization (part 5 of Article 337 of the Criminal Code). It is not known what term the serviceman was assigned.
