Military The garrison court in Yuzhno-Sakhalinsk found the serviceman guilty of failure to comply with an order and sentenced him to 2 years and 10 months in prison, representatives of the court's press service reported.
According to the court decision, the serviceman was found guilty of committing the crime provided for in Part 2.1 of Article 332 of the Criminal Code of the Russian Federation (failure to comply with an order). He was sentenced to imprisonment for a term of 2 years 10 months to be served in a general regime correctional colony. The serviceman was arrested right in the courtroom.
At the court hearing, it was established that on July 25 the man refused to carry out the order that was given to him by the commander of the military unit, because he feared for his life. According to this order, the serviceman was supposed to go to the zone of a special military operation in Ukraine on July 27 to participate in hostilities, but on the specified day he did not report for duty. The next day, he again refused to carry out the commander’s order, already in the presence of his colleagues.
The court took into account the fact that the serviceman did not hide his refusal from his comrades, trying to find support among them. Witnesses in the case reported that this influenced the commission of similar crimes by other servicemen who had previously not dared to commit such acts. In addition, the court took into account that the crime was committed during the period of mobilization.
