The French National Asylum Court (CNDA) for the first time granted asylum to a Russian who fled mobilization. Member of the Paris Bar Association Yulia Yamova, who represented his interests, told Kommersant about this.
The Russian appealed in court the refusal of the French Office for the Protection of Refugees (OFPRA). Yamova did not disclose the man's name. She clarified that he was a graduate of a Russian university, enlisted in the reserves after the military department and received a summons during mobilization.
“French officials for a long time could not believe that a man who had never served in the army and had not undergone appropriate training , is subject to conscription and sending to the front,” Yulia Yamova told Kommersant. “As follows from the reasoning part of the decision, the court also took into account the opinions of experts who believe that the conscription campaign within the framework of “partial mobilization” was carried out with numerous violations of the law. For example, in formal non-war times the right to alternative civilian service was not ensured.”
According to the defense lawyer, the decision in the Russian case will help lawyers in new claims both in the case of those fleeing the war in Ukraine and in connection with other military conflicts.
