The EC has launched an investigation against Apple and Meta*

BRUSSELS, March 25< /strong> The European Commission announced on Monday the launch of a series of investigations into possible violations of competition rules by the digital platforms Apple, Alphabet (Google) and Meta* (social networks Facebook* and Instagram*) that dominate the EU market, according to a press release from the EC.
Possible violations are recorded in connection with the provisions of the new Digital Markets Act (DMA). The European Commission must present the results of the investigation within 12 months.

“We have not been able to ensure that Apple, Alphabet and Meta* are complying with their obligations,” said European Commissioner for the Internal Market Thierry Breton.

In particular, the EU suspects that Google is abusing its virtually monopoly position to prioritize its own services for finding hotels, air tickets, and selling other services and goods in the search engine.
As for the Facebook* platform, it allows users to opt out of sharing their own data for advertising purposes only for a fee. Those who don't want to upgrade to a paid subscription but want to keep the service are effectively forced to provide their data.
The Digital Markets Act (DMA) came into force on November 1, 2022 and began to apply in the EU in May 2023. This law, according to the authors, aims to “make digital sector markets fairer and more competitive” and provide more choice and freedom to end users. For example, it obliges companies to allow the installation of third-party applications and allow users to easily change settings. The EU indicated that the DMA is one of the first tools for effectively regulating the activities of the largest digital companies. It is intended to complement, but not change, EU competition rules.

The European Commission later identified six companies — Alphabet, Amazon, Apple, ByteDance, Meta*, Microsoft — giving them six months to ensure full compliance with the obligations under the DMA.

The measures, in particular, affect social networks: Tiktok, Facebook*, Instagram*, Linkedin, instant messengers Whatsapp, Messenger, Youtube video hosting, Chrome, Safari browsers, Google Search search engine, Google Android, iOS operating systems , Windows PC OS, trading platforms and applications App Store, Google Shopping, Google Maps, Google Play and others.
The European Commission has warned that it will monitor the effective implementation of obligations under the DMA by these digital companies. In the event that a company does not comply with the obligations established by the DMA, the Commission may impose fines of up to 10% of the company's total worldwide turnover for the previous financial year, and in the event of a repeat violation, up to 20% of such turnover.
In case of systematic violations, the EC will take additional legal measures, up to and including a decision obliging the offending company to sell its business in the EU.

It was previously reported that the DMA imposes a number of obligations on large online platforms «whose dominant market position makes it difficult not to use them.» Such companies must, under EU law, in particular allow business users to access the data they generate on the platform, allow them to promote their own offers and enter into contracts with clients outside the platform.

Major internet players are also no longer able to categorize their own products or services more favorably than others on their platforms. In addition, it is impossible to prevent the simple removal of any pre-loaded software or applications, or to prohibit developers from using third-party payment platforms to sell applications.
