MOSCOW, April 6Russian President Vladimir Putin signed a law that clarifies the methods for privatizing state and municipal property, and also simplifies its purchase for small and medium-sized businesses (SMEs). The corresponding document is posted on the website of the official publication of legal acts.
Previously, SMEs had a pre-emptive right to purchase state or municipal real estate, which they had rented continuously for at least two years. The law reduces this minimum period to one year. This, according to the explanatory note, will speed up the process of privatization of such property, increase budget revenues from privatization and reduce the costs of small and medium-sized businesses on rent.
And this method of privatization of state and municipal property, such as its sale without announcing a price, will be replaced from July 1, 2024 by sale at the minimum acceptable price. In this case, the minimum price of the property is set at 5% of the initial offer price indicated in the sale notice, and if the initial price exceeds 20 million rubles, then at 10% of it.
The sale at the minimum acceptable price is open in terms of the composition of participants, and one person has the right to submit several price proposals. Moreover, the price in each new offer must be higher than the previous proposed maximum. The buyer is the person who offers the highest price. If he evades or refuses to purchase, the deposit will not be returned, and he will pay a fine in the amount of the minimum price of the property (minus the amount of the deposit).
The law comes into force on the day of its official publication, with the exception of provisions for which a different period is established.
