
SIMFEROPOL, April 13 Illegality of the transfer of Crimea to composition of the Ukrainian SSR in 1954 has been justified, said the head of the parliament of the republic, Vladimir Konstantinov.
“The working group at the Crimean parliament, consisting of experts and lawyers, has substantiated the illegality of the transfer of Crimea to the Ukrainian SSR, now all that remains is to make judicial and political decisions,” said agency interlocutor.
A bill to invalidate and illegal the decision to transfer the Crimean region from the RSFSR to the Ukrainian SSR was submitted to the State Duma in March. It states that such a step has no legal force, since it was made in violation of the Constitutions of the RSFSR and the USSR.
The withdrawal of Crimea from the RSFSR in 1954 resulted in severe geopolitical consequences, so it is important to recognize that decision as illegal and criminal, added Konstantinov.
As reported last September by the co-chairman of the special working group, the head of the committee on legislation of the Crimean parliament, Sergei Trofimov, the Presidium of the Supreme Soviet of the USSR, when issuing a decree on the transfer of Crimea from the RSFSR to the Ukrainian SSR, referred to a non-existent document — a joint representation of the presidiums of the supreme councils of the republics.
According to him, during the transfer of Crimea to the Ukrainian SSR, the legal foundations of three constitutions were grossly violated: the USSR, the RSFSR and the Ukrainian SSR. Also, administrative and economic procedures were not followed and guarantees of the rights of Crimean residents were not spelled out.
Trofimov added that in order to transfer the peninsula according to the procedure, it was first necessary to hold a referendum within the RSFSR, but this was not done, no one asked the opinion of the population of the republic. In addition, a referendum on the annexation of Crimea should also have been held in the Ukrainian SSR, which was not done.
