Vladimir Putin signed a law on increased pay for overtime work

Experts believe that in reality company owners will not shell out money

The President of Russia signed a law clarifying the system of increased payment for work above the norm. We can assume that this document concerns a large number of Russians. The authorities are making big plans for the near future. But who will implement them is unknown; there is an acute shortage of personnel in the labor market. There is only one thing left: overtime work, which will be paid in hard cash.

The document was developed by the government in pursuance of a ruling of the Constitutional Court.

According to the law, overtime work will be paid in accordance with the employer's wage systems. Including compensation and incentive payments: for the first two hours of work, no less than one and a half times the amount. And for the following hours — no less than double the amount.

As you know, unemployment in Russia at the end of 2023 is at a record low level: 2.8%. Literally all areas of activity need personnel. Experts predict that by 2030 the labor market deficit will increase to 2-4 million people.

There is no particular alternative. In this situation, it’s time to “make money” by working overtime hours.

Even the RSPP (Russian Union of Industrialists and Entrepreneurs) officially raised the question of changing the norms of the Labor Code: to allow the use of overtime work on a larger scale.

Member of the Council of the Confederation of Labor of Russia, former Deputy Minister of Labor of the Russian Federation Pavel Kudyukin believes that this is an extensive path of development.

— Instead of introducing modern technologies, he explains, we are following the path of least resistance, increasing the workload citizens. Whereas the use of innovative solutions would allow us to carry out large volumes with less effort.

      There are two aspects here: first, how is overtime regulated by law? And how is it really?

The law clearly defines that payment for the first two hours of overtime is paid at least one and a half times the amount. And if more than two hours, then double.

Such requirements are put forward to employers so that they do not have an incentive to widely use overtime, so that it would be economically unprofitable for him.

The second point is that not all employers pay for this processing. There are quite legal tricks for this. For example, actual overtime is not considered overtime if it is an internal part-time job. That is, by remaining at the workplace after 8 hours of work, the specialist voluntarily takes on additional responsibilities.

This, of course, is a fiction. A person fulfills his duties with extended working hours.

Such a system is especially common in the public sector — in healthcare and education. There are 1.5-2 rates each and this is not considered overtime and, naturally, is not paid at an increased rate.

Trade and the service sector are the same, the working day often lasts 12 hours. Some kind of accumulative modes are used, something is considered, but one can say — without any tangible additional payment.

— I’m not sure. The severity of the laws in our country, as we know, is compensated by the non-compulsory nature of their implementation.

— Maybe to the trade union, and to the labor inspectorate, and to the court. But we understand that after this he will not work for long.

Labor legislation and the rights of workers are often violated. I assume that fundamentally nothing will change with overtime in the country either.
