
MINSK, July 3 President of Belarus Alexander Lukashenko signed the law on amnesty in connection with the 80th anniversary of the liberation of the republic from the Nazi invaders. The document signed by the president was published on the National Legal Internet Portal of the Republic.
Earlier, on May 30, the lower house of the Belarusian parliament adopted the amnesty bill, and on June 20, it was approved by the upper house.
According to preliminary calculations, when implementing this law, it is planned to release from punishment, release on probation, and also replace the punishment with a more lenient one for about 5 thousand convicts. At the same time, it is planned to reduce the sentence of another 2,850 convicts by one year. In total, the amnesty will apply to 7,850 convicts.
The law establishes a list of categories of convicted persons subject to release from punishment and other criminal liability measures. Such categories are proposed to include, in particular, minors, pregnant women, women and single men with children under the age of eighteen, with the exception of those who have committed an intentional crime against a minor. The list of categories also includes persons who have reached the generally established retirement age, disabled persons of groups I and II, persons with active tuberculosis and assigned to groups I «A», II «A», III of dispensary observation, victims of the Chernobyl disaster and other radiation accidents.
At the same time, categories of persons to whom the amnesty will not apply are determined. For example, these are those persons to whom amnesty or pardon was applied during 2021-2024 and who again committed an intentional crime during the period of an unremoved or unexpunged conviction. The amnesty will not apply to persons who, on the day the sentence is passed or comes into legal force, have not fully compensated for the damage and losses caused by the crimes, have not paid the income obtained by criminal means, as well as to persons who have committed a particularly dangerous recidivism or have been recognized in the established manner as particularly dangerous recidivists.
The amnesty will not apply to those convicts whose death penalty has been replaced by a sentence of imprisonment or life imprisonment by way of pardon.
