The prosecutor's office asked to commute the sentence of a resident of the Krasnoyarsk Territory who fought in Ukraine and was sentenced to 9 years for the murder of his ex-wife

The Krasnoyarsk Regional Court, despite the request of the prosecutor's office, did not commute the sentence of local resident Alexander Borodin, who fought in Ukraine, who in March received 9 years in prison for the murder of his ex-wife. He was found guilty of inflicting grievous bodily harm resulting in the death of the victim (Part 4 of Article 111 of the Criminal Code). The decision was found on the court’s website by “Layout”.

At the end of December 2023, Borodin rented an apartment for daily rent in the city of Kodinsk and invited his former common-law wife to celebrate the New Year together, the publication writes.

According to the court ruling, during a quarrel the man beat his ex-wife. A forensic medical examination found the cause of death to be a closed blunt chest injury with rib fractures, ruptures of the parietal pleura and the right lung, which was complicated by the development of traumatic shock. At least eight blows resulted in such an injury; experts qualified this as serious harm to health. In addition, Borodin inflicted at least 244 blows on the woman, which caused hemorrhages, bruises and abrasions on her body that did not cause harm to health.

Neighbors questioned by the police said that when they met, they saw traces of beatings on the victim's face, they said that she was afraid of Borodin, and he himself did not hide the fact that he beat her.

The man insisted that “the victim provoked him, playing on his feelings and virtues for a long time, insulting him with coarse obscene language.” As “Layout” writes, after the beating, the man left his ex-wife lying on the floor and went to sleep, and when he woke up in the middle of the night and realized that the woman had died, he decided to take her body out of the apartment, but then changed his mind. In the morning Borodin called an ambulance.

Since January 3, he was in a pre-trial detention center; on March 21, the Kezhemsky District Court sentenced him to 9 years in a maximum security colony.

An appeal against the man’s sentence was filed by the acting prosecutor of the Kezhemsky district of the Krasnoyarsk Territory, Irina Aleksanina. He was represented in the regional court by prosecutor Malutina. As arguments for mitigating the punishment, she indicated that Borodin actively contributed to solving the crime, wrote a confession, gave a confession, and immediately after the beating, “he independently called an ambulance.” At the same time, “Layout” notes that by the time the doctors arrived, the woman had been dead for more than six hours.

The convict himself in the complaint expressed disagreement with the verdict “due to its injustice due to the excessive severity of the imposed punishment.” He said that the court did not take into account as a mitigating circumstance “the immoral behavior of the victim, which was the reason for the commission of the crime.” In addition, Borodin noted that the court should have taken into account that he fully admitted his guilt, “sent an apology letter to the victim,” and also that he fought in Ukraine.

Nevertheless, the Krasnoyarsk Regional Court did not heed these arguments, noting that, in passing the sentence, the first instance took into account mitigating circumstances, such as surrender, admission of guilt and remorse for the crime, as well as “the state of health of the perpetrator , his participation in a special military operation and the awarding of awards.”
