Earlier, the EU court in Luxembourg ordered Poland to pay 1 million euros per day to the European Commission as a fine for failure to comply before a court decision to terminate the activities of the disciplinary chamber for judges. The decision states that since Poland did not stop the application of the provisions related to the competence of the disciplinary chamber of the Supreme Court, it is sentenced to pay this fine. In July 2021, the EU court demanded the immediate cessation of the disciplinary chamber of the Supreme Court of Poland. According to the EC, the work of the disciplinary chamber, which can decide on the professional activities of judges, threatens their independence and impartiality. In turn, the Constitutional Court of Poland did not consider the decision of the EU Court to suspend the work of the disciplinary chamber binding. However, Poland, in response to the EC's rule of law claims, agreed to suspend the disciplinary chamber. However, the European Commission believes that Poland did not fully comply with the court's decision and continued actions that could threaten the independence of the judiciary. The European Commission has applied to the Court of Justice of the European Union to impose financial sanctions against Warsaw.
