Supreme Court: The gravity of the charge cannot be the only reason for keeping a person in a pre-trial detention center

Vyacheslav Lebedev, Chairman of the Supreme Court, said that the gravity of the charges brought against a person cannot be the only reason for his detention in a pre-trial detention center. Lebedev's words are quoted by RAPSI.

“The severity of the charges brought cannot be the only and sufficient reason to justify the detention of the accused,” said the chairman of the Supreme Court.

Lebedev also drew attention to the fact that the courts should not refuse to release a convict from punishment if he is sick, just because the administration of the correctional institution characterizes him negatively, or he does not have incentives. Also, according to Lebedev, the fact that a person does not have a permanent place of residence and social ties cannot be the basis for refusing to be released from punishment due to illness.

The Chairman of the Supreme Court noted that over the past year the number of defendants in criminal cases taken into custody. In 2021, 87,000 people were sent to a pre-trial detention center, and in 2001, 366,000. Lebedev also said that 76% of those arrested were accused of committing grave and especially grave crimes, and 53% had a criminal record.
