Senators drafted a bill to pardon prisoners for participating in the war; it will not apply to those convicted under protest articles

Senators Andrei Klishas and Olga Kovitidi have developed a bill to pardon prisoners for participating in hostilities, while it will not apply to those convicted under protest articles. Kovitidi spoke about this in her telegram channel.

According to the senator, the innovations will affect those who are serving sentences for crimes of «small and medium gravity.» But those convicted under protest articles will not be able to be released from punishment in this way. We are talking about articles about calls for participation or participation in mass riots, violation of the rules for holding a rally, “discrediting” the army, “propaganda” of Nazi symbols, calls for sanctions against Russia and military “fakes”.

“If the convict shows courage and heroism in the performance of military duty, a conscientious attitude to the performance of military service duties and thereby proves his correction, then, on the proposal of the command, the court may release him from serving the sentence or the remainder of the punishment, removing the conviction or replacing the remainder of the punishment with more mild form of punishment,” said Kovitidi.

The new law «will eliminate a gap in the current legislation» — that is, the inability of prisoners to participate in the war and «protect the interests of their Fatherland,» the senator believes. She noted that changes will be made to the Criminal Code in the form of Article 82.2. It will talk about «granting in wartime, during the period of mobilization, martial law or armed conflict to certain categories of convicts a deferral of execution of punishment in connection with sending them to participate in hostilities.»

According to TASS with reference on the text of the bill, if a convict who has received a deferment refuses to participate in the war or performs his military duties “inappropriately”, his deferment can be canceled, and the person himself can be sent to serve his sentence.

“Obviously, the Draft Law is in the interests of Russia's military security,” Kovitidi added.

Deputies of the Bashkir State Assembly made a similar proposal earlier. They submitted to the State Duma a bill providing for a deferral of punishment for prisoners who went to the war zone. According to the authors of the amendments, one day in the war should be counted as 10 days in the colony.
