United Russia proposes to increase fines for «foreign agents» and open criminal cases against them after two administrative protocols

The State Duma Committee on State Construction and Legislation will consider amendments to the bills on «foreign agents,» Anatoly Vyborny, a United Russia deputy, told Kommersant.

We are talking about two documents that the members of the commission on foreign interference prepared together with the law that has already entered into force “Oh control over the activities of persons under foreign influence”. In the first version, the reading of which took place on October 19, the amendments to both bills were technical, but for the second reading, Vyborny proposed significant changes.

According to the recommendations of the deputy, the articles 19.7.5-2, 19.7.5-4and 19.34.1The Code of Administrative Offenses will be replaced by the article 19.34 Administrative Code, which will be called «Violation of the procedure for the activities of a foreign agent.» The “general” article will have nine parts, including the activities of a “foreign agent” by a person who is not included in the register of the Ministry of Justice, missing tagging and failure to provide status information to authorized organ.

For these violations, fines from 30 to 50 thousand rubles for citizens, from 100 to 300 thousand rubles for officials and from 300 to 500 thousand rubles for legal entities are expected. Similar penalties face delays in reporting, non-compliance with the requirements for the establishment of a legal entity by new «foreign agents» and other violations related to laws on «foreign agents». As noted by OVD-Info, now the fine for the lack of marking is only 5 thousand rubles, for violation of reporting — up to 10 thousand rubles.

Unregistered public associations, according to the recommended amendments, will be liable as a legal entity. If violations are committed by a foreigner or a stateless person, he faces not only a fine, but also expulsion from the country. publish-context-cite__image» alt=»1″ />Article«Foreign Agent» and/or affiliated. The second bill proposes changes to the Criminal Code. From Article 330.1, which provides for up to 5 years in prison, the wording about “malicious” failure to comply with the law on “foreign agents” will be removed. Instead, it will be written there that criminal liability will occur if the “foreign agent” violates Article 19.34 of the Code of Administrative Offenses twice.

OVD-Info lawyer Daria Korolenko stressed that such amendments would make it possible to fine «foreign agents» and initiate criminal cases against them in a simplified manner.

In November, the government approved new plates for «foreign agents» and those who work in an organization with such status. The State Duma, in turn, adopted a bill according to which the books of «foreign agents» should be sold in thick black film, and those included in the list are prohibited from conducting educational activities among children, teaching in educational institutions, organizing public events, participating in public procurement , conclude contracts for military service and insure bank deposits.
