Certain types of payments want to increase five times
The Ministry of Education and Science plans to update the rules for payments for the results of intellectual activity that are protected by patents. On Monday, April 24, the agency submitted for public discussion the draft government decree, which provides for an increase in the share of authors in the income from the use of their developments.
As it became known to MK, the innovation should concern the authors of the so-called service inventions, useful models and industrial designs, that is, the results of intellectual activity, the copyright holder of which is the employer of the inventor. Inventors working in scientific organizations and universities will be able to count on the increase.
The current legislation provides for several types of such payments. Thus, for the creation of a service invention, the employer pays the author a remuneration in the amount of 30 percent of his average salary, for the creation of a service utility model or industrial design — in the amount of 20 percent of the salary. In addition, if the development is used by an organization, then its author is annually paid 3 average salaries for an invention or 2 average salaries for a utility model or industrial design. Finally, if the employer grants the right to use the development to a third party, the author gets 10% of the amount received for this, if the exclusive right to the invention is transferred to third parties, then the author gets 15% of the proceeds. These last two payments and proposes to increase the ministry. According to officials, in both cases, the author should get 50% of the transfer of the right to use the invention. Thus, the authors of the document note, the balance of interests of the employee and the employer is maintained.
