The Moscow City Court in the second instance decided to return the case of the actionist Pavel Krisevich for additional investigation to the prosecutor's office. This is reported by Sota with reference to its correspondent and OVD-Info with reference to a listener in the courtroom.
According to the prosecutor, the court of first instance, when considering the case, did not take into account the ideological motive of the actionist, who was accused of hooliganism with the use of weapons (Part 2 of Article 213 of the Criminal Code). In October last year, the Tverskoy District Court of Moscow sentenced him to five years in a penal colony.
The reason for the case was the action held by the actionist on June 11, 2021. The young man fired twice into the air on Red Square with noise cartridges, and then pointed a blanked pistol with the inscription «control shot» on the handle at himself. Krisevich explained his performance as a protest against political repressions in Russia.
“I believe that my sentence is illegal and unreasonable, and also too harsh. We have been talking about loud claps for two years already, although applause, salutes, firecrackers are recognized as claps. I see this as a figment of the imagination, and not mine, but the accusation. Will someone have to answer for the consequences of imagination?” Krisevich said.
Because of other actions, he had previously been placed under administrative arrest several times. After one of them, when the actionist imitated the crucifixion of Jesus Christ in Lubyanka, he was expelled from the first year of RUDN University at the end of 2021.
