In the database of the Savyolovsky District Court of Moscow, 13 cards appeared for permission to conduct searches as part of a case on the financing of extremism (Article 282.3 of the Criminal Code), Mediazona drew attention.
The court has not yet made a decision on these petitions . Moreover, on September 14, the investigation already asked for permission to conduct 16 searches under the same article, but then the Savelovsky court did not consider the materials and returned them.
According to the Criminal Procedure Code, the investigator can obtain permission from the court to search as before and after it. Searches without a court order are carried out “in exceptional cases”, after which the investigator must apply to the court within 72 hours. The judge recognizes the investigative actions as legal or illegal.
On September 20, the Savyolovsky court sent Jehovah's Witness Alexander Serebryakov, accused under Article 282.3 of the Criminal Code, to the pre-trial detention center. What exactly the believer is charged with is not yet known.
In February 2021, Serebryakov was arrested on charges of participation in the activities of an extremist organization (Part 2 of Article 282.2 of the Criminal Code), later the charge against the believer was tightened, charging him with organizing extremist activities (Part 1 Article 282.2 of the Criminal Code). In August 2022, the Golovinsky District Court of the capital sentenced the Muscovite to six years of suspended imprisonment.
Then a case was opened against Serebryakov due to involvement in Jehovah's Witnesses. According to investigators, a group of believers, including Serebryakov, held meetings and read religious literature from 2017 to 2021, despite the ban on the Jehovah's Witnesses community by the Supreme Court of Russia.
