The Railway Court of Rostov-on-Don sentenced Vasily Khabarov, a participant in the war in Ukraine, to eight months in a penal colony in the case of using violence against a security officer (Part 1 of Article 318 of the Criminal Code). Kavkaz.Realii drew attention to the decision, published on the court’s website.
On October 28 last year, police officers were called to the Vivat hotel because of the actions of Khabarov, who was intoxicated. When the security forces demanded that the man go with them, he hid his hands in an opaque bag, pretending that it contained an explosive device, and made a jerk in their direction.
“Holding his hands in this package, he made threats of violence against the police officers, namely: “I am a sapper!” I had combat experience at the Wagner PMC. I’ll pull the pin now!’” the resolution says. The security forces took his threats seriously.
As a result, the police took Khabarov out of the hotel. Already standing near the official car at the compartment for detainees, the man, according to security forces, kicked one of them in the nose. The department of the Ministry of Internal Affairs drew up a report against him under the article on disobedience to the demands of the security forces (Part 2 of Article 20.1 of the Administrative Code). Later, the court sentenced Khabarov to three days of arrest in this administrative case.
The criminal case was considered in a special manner, that is, without examining the evidence, since, according to the resolution, Khabarov fully admitted his guilt. The court took into account as mitigating circumstances the man’s participation in hostilities, as well as the presence of a commendation and a medal for bravery.
The time spent under administrative arrest and the time spent in a pre-trial detention center from October 31 until the sentence entered into force , the court calculated from the calculation: a day under arrest is equal to two days in a penal colony. The decision was made on February 7.
As Kavkaz.Realii writes, Khabarov’s full namesake appeared as a defendant in criminal cases in 2012, 2016 and 2023. The first two times he was sentenced to three and a half years in prison. The latest case was opened under the article of theft. The card on the court website states that in November 2023 “the accused fled and his whereabouts are unknown.”
