MOSCOW, March 26 The daughter of the former artistic director of the Lenkom Theater Mark Zakharov was unable to challenge the court agreements on the transfer of copyrights to his performances, the press service of the Moscow City Court reported on Tuesday.
According to the case materials, Zakharov staged the plays “Marriage” and “Falstaff” for a fee, while the exclusive rights to these productions remained with the theater and the production company.
After his death, his daughter, People's Artist Alexandra Zakharova, who became his heir, filed a lawsuit to invalidate the copyright contracts concluded by her father with the Mkayana and Kulisa companies. But the court refused her, and on Tuesday the Moscow City Court rejected her appeal, after which the decision came into force.
«The court found that the exclusive right to use the results of intellectual activity of M.A. Zakharov, which became the subject of the trial, was alienated by him during his lifetime. The author himself did not dispute the concluded agreements, received royalties for them, signed certificates of work completed. The limitation period for the claims made by Zakharova A.M. has expired,» the court explained.
