Property taxes are about to rise

The Ministry of Finance has submitted a corresponding package of bills to the government

The Ministry of Finance of the Russian Federation has prepared a package of amendments to improve the tax system in the real estate sector. As MK found out, all innovations are aimed at increasing the tax base: tax rates on sales of buildings and apartments, property tax, which is paid by citizens and legal entities to the budget once a year, as well as state duties for registering property rights with government agencies have increased. However, for low-cost properties, tariffs will remain at the same level, the department promised.

As stated in the draft of the Ministry of Finance, the current tax rate for the sale of real estate will remain at 13 %, but only if it costs less than 2.4 million rubles. But on everything that costs more, they will charge a tax of 15%. The increased tax will have to be paid not on the entire amount, but only on the difference between purchase and sale, the document emphasizes.

It will not be possible to deceive the state, as was done before, by indicating in the purchase and sale agreement the undervalued value of a house or apartment in order to pay less taxes. The fact is that in fact the tax base will be equal to the cadastral value, regardless of the transaction price. Therefore, before the transaction, the seller will have to rely specifically on the cadastral price of his property for future settlements with the Federal Tax Service. 

The department also proposes to give the legislative bodies of the constituent entities of the Russian Federation the right to increase to 1 the reduction factor of 0.7 used to determine taxable income from the sale of real estate. The amendment increases from 2% to 2.5% the maximum rate of property taxes on expensive property (the cadastral value of which exceeds 300 million rubles for each property), established by the regions.  

For properties worth less than 300 million rubles, the maximum property tax rate will remain at the same level. That is, 0.1% of the cadastral value of houses, apartments, rooms, garages, parking spaces, outbuildings on garden or subsidiary plots. And 0.5% of the value for all other properties. At the moment, local authorities can vary these rates.

In addition, it is proposed to change the formula for collecting state fees for registering ownership of real estate and subsequent entering information into the Unified State Register, moving from a fixed tariff to a percentage of the transaction value. Now this amount is fixed in the Tax Code of the Russian Federation: citizens who purchase housing must pay 2 thousand rubles, and legal entities — 22 thousand rubles. The Ministry proposes to maintain this payment amount if the cadastral value of the asset does not exceed 20 million rubles. For all objects that cost more than 20 million rubles, you will have to pay more. Moreover, state duty rates will be different for citizens and legal entities. 

As stated in the document, when making transactions with them, individuals will have to pay 0.1% of the transaction amount, but not less than 0.1% of the cadastral value of the asset. In this case, the maximum payment amount will be 500 thousand rubles. For organizations, the fee will be 0.3% of the transaction amount, but also not less than 0.3% of the cadastral value of the property. It, in turn, cannot exceed 1 million rubles.

According to MK, the government does not intend to delay the consideration of these initiatives. Most likely, they will be adopted in the near future. So that State Duma deputies have time to quickly approve all amendments to legislation this session. Until the summer holidays.
