The poet and creator of the public page “Pre-revolutionary Adviser” Vyacheslav Malakhov admitted guilt in the case of “discrediting” the Russian army (Part 1 of Article 280.3 of the Criminal Code) and asked to consider his case in a special manner in court. This means that the defense will not present evidence of Malakhov’s innocence, and the court will not study evidence of his guilt.
Today, the prosecutor's office asked to extend the poet's arrest until November 30. This was reported by a Mediazona correspondent from the Khamovnichesky Court. The state prosecution motivated, among other things, the extension of the preventive measure by the fact that “Malakhov is found to have harmful use of psychoactive substances.”
“I would like to ask that the preventive measure be changed to a lighter one. “I have guarantees from people,” Malakhov objected. — We discussed a special procedure. In general, I admit my guilt.»
«To be honest, I have nowhere to hide, and there is no need. “I am not some kind of enemy of Russia,” the accused added.
Lawyer Tatyana Solomina also noted that Malakhov’s relatives are ready to post bail for him.
“I grew up in Tajikistan, I saw the civil war there. My dream is for all Russian soldiers to return home alive. I ask the court for leniency. I didn’t think that I would celebrate my birthday here,” the poet addressed the court.
Nevertheless, Judge Diana Mishchenko extended the arrest of Vyacheslav Malakhov for the period requested by the prosecutor’s office. The poet remains in jail.
Immediately after admitting guilt and extending the preventive measure, Judge Diana Mishchenko does not proceed to discuss a special procedure for a quick sentencing, and unexpectedly for Vyacheslav Malakhov and his lawyer Tatyana Solomina, he proposes to transfer the case to the Petrograd Court of St. Petersburg.
The Poet admitted guilt and is ready to consider the case without studying the evidence — which usually takes no more than one meeting. Lawyer Solomin asked not to change jurisdiction, since she lives and works in Moscow.
Nevertheless, Judge Mishchenko decided to transfer the case to St. Petersburg. Now Malakhov should be transferred to one of the St. Petersburg pre-trial detention centers.
The criminal case against the poet became known on January 31 last after his arrest in Moscow. On February 2, his Moscow Golovinsky Court sent Vyacheslav Malakhov to a pre-trial detention center, where he is still being held.
The reason was an anti-war post in Malakhov’s telegram channel on September 8. The publication begins with the words “Nobody wants to fuck you in your withered ass, grandpa, relax.”
“But with the Orthodox, everything is already clear: kill, steal, commit adultery, bear false witness… and that Wagnerian from the news doesn’t even respect his mother, he fucking killed her with an ax. That is, you Orthodoxy violated ALL the commandments with this war, oh, sorry, the SVO,” wrote Malakhov.
In August, the Savyolovsky District Court of Moscow fined the poet 30 thousand rubles in an administrative case about “discrediting” the army ( Part 1 of Article 20.3.3 of the Administrative Code) due to anti-war posts on VKontakte.
That same month, Malakhov told human rights activists from the “Team Against Torture” that the police removed him from the train and forced him to sign an agreement to voluntarily be hospitalized in a psychiatric hospital, where he spent about a month. There, the poet, according to him, was injected with unknown drugs, and hospital staff and security forces used force against him. He was later diagnosed with a rib fracture.
Malakhov was one of the authors of the “Pre-Revolutionary Soviet” public page on VKontakte. Since the summer of 2011, memes in pre-revolutionary spelling have been published there, and later also parody poems and covers of modern songs, stylized in pre-revolutionary language. Now there are 68 thousand subscribers. The public is now accessible, but Malakhov’s own page was blocked in Russia at the request of the Prosecutor General’s Office in 2023.
In a telegram, the poet said that the “Pre-revolutionary Advisor” project was offered to make parodies of people recognized as “foreign agents”, but he refused.
