The rules for receiving the remainder of the maternity (family) capital, the bulk of which was spent by parents for purposes provided by law, were developed by the Russian Ministry of Labor. The draft government resolution prepared by the ministry is posted on the portal of regulatory legal acts.

If the resolution is signed, the right to receive the remainder in the form of a one-time payment will be granted to parents who at one time received a state certificate for maternity (family) capital, but did not fully spend the funds provided under it. The main condition is that the remaining amount should not exceed 10 thousand rubles.
Children will be able to receive money under the same conditions. They will receive this right if the only parent or adoptive parent of the child dies, is declared dead or is deprived of parental rights in relation to the child in connection with whose birth the state provided. However, the child will be able to receive the money only upon reaching the age of majority or acquiring legal capacity. If there are several children, the remainder of the maternity capital will be divided between them in equal shares.
The Pension and Social Insurance Fund will notify citizens through the unified portal of state services that the maternity capital has not been fully spent. An application for funds can be submitted either through the same portal or through government service centers in person, through a representative, or by mail.
The money will be transferred within five days after the decision is made to provide a one-time payment.
