The Verkhovna Rada has registered a draft law on criminal liability for illegal border crossing by men of military age during the war. Now criminal liability has been established only for the illegal transfer of persons across the state border, reports the Chronicle.info with reference to RBC-Ukraine.
«In the context of a full-scale war with the Russian Federation, it is advisable to establish criminal liability for illegal crossing of the state border by citizens of Ukraine, who, according to the Constitution of Ukraine, are obliged to defend Ukraine under the legal regime of martial law», — says the explanatory note to the draft.
It is proposed to supplement the Criminal Code with an article «Illegal crossing of the state border of Ukraine during martial law»:
- 1. Crossing the state border of Ukraine during the operation of martial law by a person who, in accordance with the law, is assigned to the conscription station (conscript) by any means outside the checkpoints across the state border of Ukraine or at the checkpoints across the state border of Ukraine without relevant documents or according to documents containing misleading or hiding from border control, — shall be punishable by a fine of five thousand to ten thousand tax-free minimum incomes of citizens (from UAH 85,000 to 170,000) or imprisonment for a term of three to five years.
- 2. The same actions committed by military personnel and persons liable for military service, reservists who are subject to conscription for military service during mobilization, as well as persons authorized to perform the functions of the state or local government, & # 8212; shall be punishable by imprisonment for a term of five to ten years, with deprivation of the right to hold certain positions or engage in certain activities for a term up to three years.
- 3. The actions provided for by parts one or two, committed repeatedly either by a group of persons or by an official using his official position, & # 8212; shall be punishable by imprisonment for a term of eight to twelve years, with or without deprivation of the right to hold certain positions or engage in certain activities for up to three years.
Recall, February 24, 2022 State Border Guard Service of Ukraine said that in connection with the introduction of martial law in Ukraine, it is forbidden to leave Ukraine for male citizens of Ukraine aged 18 to 60.
