The garrison military court of Makhachkala recognized the early dismissal of a serviceman of the Caspian flotilla Firudin Gadzhibekov for refusing to participate in the war in Ukraine, Kavkaz.Realii writes. The decision was made on September 9th.
The lawsuit of Gadzhibekov, who demanded to reinstate him in the service, says that on May 4, the commander of his combined battalion, in a general formation, said that the military should go to Ukraine «to perform special tasks during the ongoing special military operation.» Gadzhibekov refused, because the commander “did not submit a written combat order,” and the military himself needed medical attention because of a sore back.
Two days later, the commander brought Gadzhibekov to disciplinary responsibility «in the form of early dismissal» due to non-fulfillment of the terms of the contract. On May 20, an order was signed on his dismissal.
The former soldier asked to recognize both orders as illegal, but the court refused to satisfy the claim.
Hadzhibekov served under the contract for more than 10 years.
