The court in Ufa dismissed the conscript's case on «discrediting» the army; the protocol was drawn up after the denunciation of the military commissar

The Kirovsky District Court of Ufa dismissed the case of conscript Arsenty Artyukhov about «discrediting» the army (Part 1 of Article 20.3.3 of the Code of Administrative Offenses) on the denunciation of the military commissar. It is reported by Mkset.

At the end of March, Artyukhov wrote an application for alternative service. The military commissar of the Kirovsky and Leninsky districts of Ufa found in it signs of «discrediting» the army and «the decision of the President of the Russian Federation to conduct a special military operation» in Ukraine. He wrote a denunciation to the police demanding to check the conscript's words and take measures to bring him to criminal responsibility. The police did not find the corpus delicti and did not open a criminal case. However, a protocol on an administrative offense was still drawn up against him.

Artyukhov himself explained that his statement was not public and was written in accordance with the Federal Law «On Alternative Civil Service» (113-FZ).

The court decided that the protocol did not contain a description of the event of the offense: it did not state what public actions of the conscript «pointed to the discrediting of the use of the Armed Forces.» In addition, the judge agreed with Artyukhov, recognizing that his statement was not public, since it was addressed to the commissioner and aimed at the implementation of the constitutional right of the young man.

In June, a court in Stavropol fined a conscript 40,000 rubles for calling the war in Ukraine “disgusting and criminal” at the military registration and enlistment office.
