Details of a high-profile trial
The Khimki city court ruled on the lawsuit filed by the parents of a fifth grader who received more than a hundred stab wounds in the lyceum toilet from a classmate against the educational institution and the family of the culprit.
Recall that in February at the Khimki Lyceum, during a break between lessons, 12-year-old Milena (all names have been changed) called her classmate Sveta to the toilet, where she attacked her with a knife. The girl was hospitalized in serious condition, she managed to survive and will need a long recovery. In fact, a criminal case was initiated under the articles of the Criminal Code of the Russian Federation “Attempted murder” and “Negligence”. Milena has not reached the age when she can be prosecuted, so in terms of the attempt, the case will most likely be closed. Who specifically will be punished from among the responsible persons is not yet known, an investigation is underway. Meanwhile, Sveta's parents filed a lawsuit against the Lyceum, the director and parents of the attacker, demanding to recover more than 25 million rubles of expenses and compensation for moral damage.
As MK learned, on July 7, on Friday, representatives of the Lyceum administration asked to postpone the meeting, but the court limited itself to an hour break.
Sveta's mother did not appear in the process, her representative said that the woman was taking the tragedy hard and referred to her state of health. The father of the victim, in his speech, noted that the trouble came to the house of both families (both Sveta and Milena), supporting the claims. Namely, to recover about 158 thousand rubles of expenses already incurred, 5.6 million rubles of future expenses, 10 million in favor of the girl's parents and 10 million to herself.
The representative of the lyceum stated objections at the meeting, first of all, about the size of the requirements. Also, according to him, the tragedy is not the fault of the educational institution, since all the employees performed their duties.
children are responsible for the administration of the educational organization where they study.
As a result, Themis partially satisfied the claim. The court ruled to recover from the lyceum in full the incurred and future expenses, and the moral damage was estimated at 1 million for the injured child and 1 million for the parents — 500 thousand rubles each.
In terms of recovering funds from the director and parents Milena's court agreed with the position of the prosecutor's office and they were refused to issue an invoice.
The representative of the defendant, Milena's mother, lawyer Sergei Yegorov, told MK that he was satisfied with the court's decision regarding the principal and did not plan to appeal it.< /p>
Representatives of Sveta's parents said they would appeal to the appellate instance and complain about the decision.
