The Vilnius District Administrative Court of Lithuania overturned the decision of the Migration Department to annul a Russian citizen's permanent residence permit. The court ruling is quoted by the LRT TV channel.
Permanent residence permit issued to a Russian citizen cancelled after evaluation by the Lithuanian State Security Department. The department considered that the man “poses a threat” due to the fact that until 2002 he worked in a strict regime colony in the village of Smirnykh on Sakhalin.
On August 31, the panel of judges indicated that when making this decision, it was not established specific facts of threats, including «any actions within the framework of intelligence tasks» that the Russian would represent, and satisfied the plaintiff's complaint. The court does not name him.
“The hypothetical probability of a future threat, not based on the past unlawful actions of the applicant, from the point of view of the panel of judges, may correspond to the content of the concept “may threaten”, but not the content of the concept “threats” ;,” the court ruling says.
