UFA, September 13 The Leninsky District Court of Ufa recovered 31 million rubles from the state in favor of a local resident who served 13 years in a colony for murder, which he did not commit, the joint press service of the courts of Bashkiria reported.
“The Leninsky District Court of the city of Ufa considered a civil case based on the claim of Fatkhulla Iskhakov to the Ministry of Finance of the Russian Federation for compensation for moral damage caused by illegal criminal prosecution,” the statement says.
During the trial, the plaintiff stated that between May 23, 1959 and June 14, 1972, he was subjected to unlawful criminal prosecution on charges of attempted murder of two or more persons. Criminal prosecution included the stages of pre-trial proceedings, consideration of a criminal case in court and serving a sentence in a correctional institution. At the same time, the plaintiff was in custody all this time, the press service reports.
According to the press service, by a ruling of the Supreme Court of the Russian Federation dated May 25, 2023, the people's court's conviction of October 19, 1959 against Iskhakov was overturned, and the criminal prosecution was terminated due to non-involvement in committing a crime.
«By the decision of the Leninsky District Court of Ufa, the claims of Fatkhulla Iskhakov were partially satisfied. It was decided to recover from the Russian Federation, represented by the Ministry of Finance of the Russian Federation, at the expense of the treasury of the Russian Federation in favor of Iskhakov in compensation for moral damage of 31,650,800 rubles», — the press service clarifies.
The rest of the claim was denied. The court decision has not entered into legal force, the court added.
