The 35th garrison military court in Petropavlovsk-Kamchatsky sentenced seven contract soldiers who refused to participate in the war against Ukraine to two and a half years in a penal settlement. Information about this was published on the court’s website, Mediazona noted.
All seven servicemen from December 27 to January 12 were found guilty of failure to comply with an order during a military conflict (Part 2.1 of Article 332 of the Criminal Code).
Alexander Agafonov was sentenced to two years and three months in a penal colony. According to investigators, in the fall of 2023, he violated the commander’s order and refused to go to the front under the pretext of “poor health.”
In January, serviceman Ivan Morshchakov received two years and one month in a penal colony. Contract soldiers Mikhail Filippov and Alexander Bykov were sentenced to two years and two months each. All three also refused to fight last fall.
Three more military personnel refused to participate in hostilities in the summer of 2023. Artem Mirkin was sentenced to two years and three months in a colony-settlement, Artem Neshtun — two years and four months in a colony-settlement. At the end of December, Alexander Maksimov was sentenced to two and a half years in a penal colony.
As Mediazona previously found out, in 2023, the courts received 421 cases related to non-execution of orders (332 criminal codes). Now this is the mildest way in terms of punishment to avoid being sent to the front.
