MOSCOW, July 25 The State Duma adopted in the first reading a bill tightening the requirements for the qualifications and business reputation of officials of financial organizations.
The document was submitted by a group of deputies and senators. It updates the requirements for business reputation imposed on managers and their deputies, members of collegial executive bodies of credit, insurance and microfinance organizations, NPFs, management companies of investment funds, mutual funds and NPFs, as well as their owners.
At the same time, the circle of persons whose negative experience is taken into account when assessing business reputation is specified. Moreover, it is directly stated that in the event of bankruptcy of a financial organization, the business reputation of its owners is recognized as unsatisfactory, explained earlier the co-author of the bill, the head of the State Duma Committee on Financial Markets Anatoly Aksakov.
And the list of grounds for recognizing business reputation as unsatisfactory has been supplemented with new criteria. These will include bringing the assessed person to administrative or criminal liability for offenses or crimes related to the implementation of activities supervised by the Bank of Russia without an appropriate license, illegal issuance of consumer loans, or the organization of financial pyramids.
A number of criteria have been introduced related to the involvement of the assessed person in extremist activities or terrorism, with the blocking of his funds or property as part of counteracting the financing of terrorism, with the creation of obstacles on his part to conducting inspections in accordance with anti-money laundering legislation, or failure to comply with the relevant instructions of the Central Bank.
In addition, a ban is established on the transfer of the functions of the sole executive body of a financial institution to several persons acting jointly, and on the formation of several sole executive bodies in a financial institution acting independently of each other.
