MOSCOW, August 8 Russian President Vladimir Putin signed a law establishing the need to certify a mediation agreement in the field of loans through the provision by a credit institution to a notary of a document confirming the transfer of funds to the borrower in non-cash form. The corresponding document is posted on the website of the official publication of legal acts.
It is established that a notary is provided with a document confirming the transfer of funds to the borrower or the transfer of other things to him. A mediation agreement, the subject of which is the settlement of a dispute about the failure to fulfill the terms of a loan agreement related to the return of funds, is certified if the funds are transferred to the borrower in non-cash form. In this case, the notary is provided with a document issued by the credit institution confirming the transfer of funds to the borrower.
The notary will be obliged to verify the authenticity of this document by sending a request through a single information system to the credit institution, which will be obliged to confirm the authenticity of the information.
The law comes into force 180 days after the day of its official publication.
