Five rooms in the center of Moscow will cost 9,900 rubles per day
The State Duma is going to consider a law that will resolve the contradictions associated with the possibility of renting out housing on a daily basis. Today, every Russian can set up an apartment for tourists in his apartment (read: rent it out to a new person every day), and his neighbors don’t always like it. MK discussed with experts what could change the new law if it is adopted.
Currently, according to current legislation, citizens are prohibited from using apartments in apartment buildings to provide hotel services. However, Vladimir Gruzdev, Chairman of the Board of the Russian Lawyers' Association, believes that renting out an apartment on a daily basis does not turn the apartment into a hotel. This issue is not spelled out in the legislation, so in practice there may be conflicts: it looks like a hotel, but at the same time it looks like an apartment. If the situation is interpreted by the courts as providing hotel services, such landlords become violators. Although the daily rental of a private apartment cannot be equated to hotel services “without a thorough assessment of all the circumstances.” This verdict was issued by the Constitutional Court of the Russian Federation when considering one similar application.
To avoid controversial situations, according to lawyer Gruzdev, it is necessary to regulate “the specifics of the short-term provision of residential premises to accommodate citizens, maintaining the necessary balance of interests of all participants in such legal relations.”
As realtor Elena Tolstikova explained in an interview with MK , such a law would be very timely, since at present “there is a conflict of law.”
“On the one hand, there is a law that limits the maximum term of a rental agreement, but the minimum period is not specified,” the expert explained. — On the other hand, short-term rental is now equated to the hotel business, which is prohibited in the housing stock. And it turns out that according to one law they are violating — if we equate short-term rental for 1-2 days to the hotel business, but according to another law that regulates the rental agreement for residential premises — it seems that they are not, since the minimum rental period is not specified. The amendments will provide clear clarification on this issue.
“MK” found out how things are with prices on the daily rental market in Moscow and the surrounding area by going to the corresponding website. They rent and rent very actively. For example, a studio apartment of 27 sq. m in Khimki is provided for a day for 2300 rubles. It, according to the announcement, has “everything you need for a business trip, family or romantic getaway.” For comparison, a 3-star hotel is also in Khimki. A room of approximately the same size with a double bed will cost 3,462 rubles. per day. The benefit is obvious.
The cost of daily rental housing ranges from 1,600 to 3,200 rubles — depending on the area and conditions, of course. For example, a modest studio (but on Maroseyka!) can be rented for 6,990 rubles per day, and a luxurious five-room apartment nearby can be rented for ten thousand.
According to the realtor, many people usually prefer rented apartments to hotels — especially guests of the capital who come for a few days and want to arrange their life in a way that suits them (at least for a while!). Families with children love this format. This is convenient for many: for example, you can cook your own food and stay comfortably, even if there are 4-5 people in the family.
We ask the realtor one more question: how to take into account the interests of neighbors so that renting out an apartment to different strangers does not violated their rights, did not interfere with them?
“It is clear that there may be inconvenience for neighbors,” the expert argues. — But they can also be from other neighboring owners or tenants under a long-term contract. In any case, all responsibility for noise and other possible problems should be placed on the owners. If you want to make a profit, you must bear responsibility.
