The Kondinsky District Court of the Khanty-Mansi Autonomous Okrug again did not fine local teacher Alena Ishimtseva under the article on “discrediting” the army (Part 1 of Article 20.3.3 of the Administrative Code). This follows from the case file, to which Mediazona drew attention.
According to information on the court’s website, the protocol was drawn up by “unauthorized persons,” and at the end of October the case was returned to the police to eliminate violations. Since the security forces did not provide the corrected materials within three days, it was handed over to the judicial records department.
The same thing happened at the end of September. The website posted a ruling to return the case to first time. It follows that near the school in Kondinskoye three A4 sheets with the inscription “Kondinsky! Children! Don't participate in the fair! It is held in support of the War in Ukraine! NO TO WAR» and an image of the Ukrainian flag. The security forces believe that Ishimtseva posted them.
As for the violations committed by the police, Judge Leonova indicated that from one of the protocols for examining the scene of the incident, “it is impossible to establish the date of its compilation, position, surname and initials of the person” who prepared the document. Also, the protocols do not indicate what equipment and under what conditions the scene of the incident was photographed, which makes these protocols unacceptable evidence. In addition, the judge indicated that the operative did not explain all the rights and obligations of Ishimtseva and her husband, who was interviewed as a witness.
Ishimtseva’s detention became known on September 15. As the telegram channel “Caution, News” wrote, on the night of September 12, near a school in the village of Kondinskoye, unknown persons posted anti-war leaflets with Ukrainian flags. In the morning, the management of the educational institution found out about this and called the police. Ishimtseva was later detained.
Publications 86.RU and Muksun, citing a source in law enforcement agencies, reported that the police had found a witness in the case. He claims that he saw Ishimtseva on the school grounds at night — she was posting leaflets.
“Muksun” wrote that together with Ishimtseva, her husband Grigory, who runs the “Sculpture” children’s association at the same school, was detained. The police did not draw up an administrative report against him, the publication clarified. At the police department, both detainees refused to give explanations, citing Article 51 of the Constitution.
