The State Duma adopted amendments tightening penalties for illegal storage and processing of personal and biometric data

Deputies of the State Duma, in the third and final reading, adopted a law tightening penalties under the administrative article on the storage of personal data, according to the website of the lower house of parliament.

The amendments introduce a new article 13.11.3 into the Code of Administrative Offenses — on violation of requirements in the field of placement of biometric data by banks, MFCs and “other organizations”. It stipulates fines for illegal placement and updating of biometric data: from 100 to 300 thousand rubles for officials and from 500 thousand to 1 million rubles for legal entities.

The punishment under Article 13.11 of the Code of Administrative Offenses, relating to personal data, is also being tightened. For collecting them without the consent of the owners, officials face a fine of 100 to 300 thousand rubles, legal entities — from 300 to 700 thousand. In case of repeated violation, fines will range from 300 to 500 thousand rubles and from 1 million to 1.5 million rubles, respectively.

Among the authors of the amendments are Vyacheslav Volodin, Irina Yarovaya, Leonid Slutsky, Sergei Mironov, Yaroslav Nilov and other parliamentarians.

The day before, several bills were introduced to the State Duma, which, if adopted, would tighten punishment for leaks of personal and biometric data. As United Russia deputy Andrei Turchak explained, fines for officials will reach 2 million rubles, and for legal entities — 15 million rubles.

One of the introduced bills also proposes to introduce a new article 272.1 into the Criminal Code on the “illegal” use, transfer, collection and storage of personal and biometric data obtained through “illegal access to information.” The punishment under this article will be from four to ten years in prison.

Penalties of up to five years in prison are also planned for creating resources or programs intended for the “illegal” storage and transmission of information containing personal data. According to First Department lawyer Evgeniy Smirnov, the adoption of such an article of the Criminal Code will make it possible to bring journalists and investigators to criminal liability.
