A family in the United States has filed a lawsuit against a nursing home, accusing the facility of negligence and wrongful death after a woman was sent to a funeral home for embalming while she was still breathing, The New York Post reports.
The publication reports that on February 4, 2023, staff at the New York State Nursing and Rehabilitation Center mistakenly declared 82-year-old Janet Balducci dead and wasted no time in sending her to prepare for a funeral.
According to the family's lawyer, when the woman arrived at the funeral home, it was discovered that she was «still breathing and had a pulse.»
Less than a day later, Janet was rushed to the hospital, and she did indeed die. Her angry sons have filed a lawsuit against the nursing home in Suffolk County Superior Court.
«There's really no justification for putting a living person in a body bag and sending it to a facility to be embalmed. There was no one there to protect her as an elderly person,» the attorney added.
