Judge Natalya Shabasheva of the Chertanovsky District Court extended the detention of 37-year-old Mosgortrans driver Vyacheslav Samusev until December 28 in the case of “fake news” about the army (clause “e” of Part 2 of Article 207.3 of the Criminal Code). This was reported by a Mediazona correspondent from the courtroom.
Samusev did not object to the extension of the arrest. At the beginning of the hearing, he tried to petition for a fine to be imposed on him. “I have the opportunity to pay for it even in the courtroom,” Samusev said.
The court reminded him that the case was just beginning to be considered on the merits, and therefore they could not sentence him today.
Samusev’s lawyer Sergei Balashov, in a conversation with Mediazona, said that his client admits guilt and the defense will not appeal the preventive measure. Balashov is a lawyer by appointment.
From the prosecutor’s request to extend the arrest, it follows that Samusev was sent into custody on August 28, 2023 in the case of calls for terrorism (Part 2 of Article 205.2 of the Criminal Code). The BRIEF Telegram channel wrote that a case of calls for terrorism was brought against Samusev because of his posts on VKontakte, where “in addition to supporting Azov,” he called for the assassination of the Russian President.»
On April 15, Vyacheslav Samusev was added to the Rosfinmonitoring list of terrorists and extremists. On May 8, 2024, a new criminal case was opened against him regarding “military fakes.” It is still unknown which posts formed the basis of the new criminal case.
On May 15, 2024, the cases were combined into one proceeding, but later a resolution appeared in the materials on the “partial cessation of the criminal prosecution” of Samusev under the article on calls for terrorism .
Lawyer Balashov could not explain to Mediazona what “partial cessation of criminal prosecution” means. According to Article 175 of the CCP, the investigator can partially terminate the criminal prosecution if “the accusation brought in any part of it has not been confirmed.”
The court will begin to consider the criminal case on the merits on August 13.
